I have purposely taken a break from posting.  This story popped up and I thought it was interesting enough to put out on the board to see if anyone wanted to kick it around.

I’m not really interestested in debating the morality of abortions but what this move made in Alabama means.  From what I have read, this bill was crafted in such a manner as to be sent to SCOTUS to challenge Roe V Wade.

This bill doesn’t punish the mothers but the bill will make the punishment for performing abortions up to 99 years or life in prison, although the woman who received one will not be subject to a felony charge.

If you are a libertarian, you would probably say that this is a 10th Amendment issue and SCOTUS would say this is a States Rights issues as there is nothing in the US Constitution about this issue.  If you are a support of abortion right you would probably disagree.

Alabama needs to get ready for a ton of boycotts and negative press.

You’re right about them most likely getting a lot of backlash for it.

It will be interesting to see what the court decides on this one and on what grounds. I can see the argument for a states rights claim, but I think they would decide one way or the other since, depending on how you look at it, it’s a combination of issues around a life and around personal privacy and medical decisions.

I don’t know if SCOTUS would overturn it’s own ruling even if the Conservative Justices felt they could do so.  It would lay the groundwork for any decision to overturned and I’m not sure how that would play out.

I agree. It would be a huge step to overturn a decision like Roe v Wade. I don’t see that happening. What would be interesting is to see if they moderated the framework that Roe v Wade outlined on the timeline of where states can limit abortions. This was set out as to when the states had the right to protect the potential life balanced with the mother’s privacy. I wonder if they would revisit that based on medical advances. I doubt it but it would be interesting - rights an “interests” aren’t typically changed with technology.
